Data Privacy Consent Terms
The individual signing this application certifies that they are an authorised Principal, Partner, Officer or other authorised representative (together, “Authorised Representatives”) of the applicant identified above, and are thereby fully authorised to bind the applicant to contractual obligations and are authorised to provide the information contained in this application. The signatory to this application also certifies that all information and documentation submitted in connection with this application is complete and correct in all material respects. The completion of this application does not imply acceptance by any Worldpay company.
The applicant authorises Worldpay to obtain and verify, and to continue to obtain and verify, any information submitted in this Application Form, including banking information, financial credit, other information about the applicant, any relevant information regarding Authorised Representatives of the applicant, and any other individuals listed in this Application.
The signatory to this application consents to the processing of their personal data (to the extent such consent is required under applicable law), including to obtain a credit report from any credit reference agency (“CRA”), for the purposes of providing services to the applicant and for compliance with Worldpay’s legal obligations related to Anti-Money Laundering, Know-Your-Customer, anti-terrorism, export control laws, and prohibitions on doing business with restricted persons or in certain business areas. Worldpay shares applicant’s personal data with:
relevant affiliates (other parts of Worldpay, or Worldpay group companies);
third-party service providers (including information technology service providers, credit reporting agencies, identity, risk, fraud, and compliance service providers (e.g. for transaction risk monitoring); debt service providers (e.g. for debt collection analysis or management); and for business analytics (e.g. for data aggregation, visualisation and reporting);
business partners (including payment processors, payment infrastructure providers, digital wallet providers, banks, and other financial institutions);
professional advisors (accountants, consultants, lawyers, and tax advisors);
advertisers (where a Worldpay customer opts in);
law enforcement, regulatory, prosecuting, tax or governmental authorities, courts or other tribunals or dispute resolution bodies;
prospective sellers or buyers as part of a sale or merger of Worldpay, business or assets; and
any other third party to the extent the disclosure is required by a law which applies to Worldpay.
As Worldpay is a global business, the above recipients may be based internationally (that is, in a different country or territory to the applicant). Personal data may therefore need to be transferred cross-border. To the extent this application includes personal data of other Authorised Representatives of the applicant other than the signatory’s own personal data, the signatory confirms they have obtained the other individuals’ consents (to the extent required under applicable law) for providing such data to Worldpay.
